Limitation of Liability

Zabface total aggregate liability from any and all claims under the Terms is limited to the total amounts you paid to Zabface in the one (1) year immediately preceding the occurrence of loss or damage. To the extent any province, state or jurisdiction does not allow the exclusion or the limitation of liability for consequential or incidental damages, Zabface liability in such province, state or jurisdiction will be limited to the furthest extent permitted by law.
You agree to defend any claim, demand, suit or proceeding (including, without limitation, any proceeding, investigation or claim by a governmental, administrative, or other regulatory agency or entity) made or brought against Zabtel LLC or its affiliates and their officers, employees, directors and agents arising from or in connection with (a) Your Content, (b) your use of the Site or Services, (c) your violation of these Terms, (d) your violation of any applicable law, and (e) any violation of an intellectual property right. You also agree to indemnify Zabtel LLC for any damages finally awarded against, and for reasonable expenses, such as attorney’s fees, incurred by, Zabtel LLC in connection with any such claim, demand, suit or proceeding.
